February 12, 2007

Present: Chairman Deanna Huot, Selectman Peter Moore, Selectman Patricia McTeague, Town Manager Ted Sutton, Recording Secretary Susan Chenard

Audience Members: Charlie Cook, Wilfred Bishop

Approval of public meeting minutes of February 5, 2007: A motion was made by Selectman Moore, seconded by Selectman McTeague, to approve the public meeting minutes of February 5, 2007, as amended.

Routine Business

? Appointment of Trustee of Trust Funds - After publicly noticing for the position of Trustee of Trust Funds, Lutz Wallem was the only person who expressed interest in this position. Given his good financial background, as evidenced by his participation on the budget committee this year, a motion was made by Selectman McTeague, seconded by Selectman Moore, to appoint Lutz Wallem as Trustee of Trust Funds, to complete the balance of the term left vacant by Ruth Bossie's departure. He must be sworn in by Susan Whitman.



? Health Officer Recommendation - After publicly noticing for the position of Health Officer for the Town of Lincoln, a motion was made by Selectman McTeague, seconded by Selectman Moore, to recommend Susan Chenard to the State of New Hampshire Department of Health and Human Services as the Town's new Health Officer.



? Town Report Update - The Town Report is almost complete. The Selectmen chose a cover from two options provided to them. Just a few department reports are left to be completed.



? Review of meeting with Ron Cote from the New Hampshire State Department of Revenue- Town Manager Sutton met with Mr. Cote this week and will write up a report on the details. The important thing to note was that we received essentially an "A" on the town revaluation. There was also a short discussion on an abatement being sought by one condominium association.



? Pleasant Street update - Town Manager Sutton received new plans from the engineers showing that the turnaround, that will be necessary at the end of the Pleasant Street project, is located on Lin-Wood School property. Mr. Sutton will send a letter to the school board requesting an easement for this turnaround at the end of Pleasant Street.



Other Business

? The Lincoln Business Park Dedication event is cancelled for this week due to conflicts with legislative calendars and the impending snowstorm.

? Mr. Sutton updated the Board of Selectmen on the Corps of Engineers letter of deficiency and decertification of the levee/dike. He has received many calls, including from Representative Sununu's and Senator Gregg's offices, who have offered support, and meetings are pending. There was discussion on the Rapids development, owners of the property behind the levee, in regards to flood plain and ownership. When the Selectmen signed an agreement w/ the Corps in 1960, it was to maintain, not to repair, the dike. The Town of Lincoln maintained the dike, and received positive inspections of the dike, up until the 1995 flood, which caused the damage to the dike that is being cited in their letter. At the time of the damage to the dike in 1995, the town notified the Army Corps of Engineers in hopes of assistance with the repairs. The Corps of Engineers has stated that the 1995 flood did not meet the 300-year flood criteria and therefore was not eligible for funding or assistance The most puzzling part to their request requiring the town to repair the dike is the statement that they have made that specifies that if the dike were repaired, it may not meet the new regulations being developed by FEMA regarding flood plain insurance criteria.



? The bid opening for Pleasant Street has been rescheduled for Feb 20th at 3pm.



? The Town Manager reported that Centex Destination Properties (CDP) is coming back before the Planning Board on Wednesday the 14th for continuation of approval of their development plans. He had some concerns regarding the development plan for CDP, so he has requested that the town engineers, Hoyle Tanner Associates, present those concerns to the Planning Board at their meeting.



? Centex has also applied for approval of a booster pump station for a 27-lot development. A 250,000-gallon water tank is required for this development. However, CDP wants to hold off on the installation of the tank until more construction is completed. Chairman Huot asked about when the new water treatment cell would be necessary. The Town Manager responded that he has been working with the town engineers and the developers to establish a schedule as to when the construction of the new water treatment cell would be required. The Developers have agreed and we have been collecting funds that will pay towards the new water treatment cell and improvements to the sewer system, but we need to plan when construction should start.



? Selectman Moore asked about the invitation we had received from the LinWood School Superintendent, inviting State and local representatives. From reading the letter, it was difficult to understand the subject of the meeting. Mr. Sutton said that he would request further information to clarify the subject of the meeting.



? Selectman Huot asked about the free AARP tax service. Quite a few individuals have taken advantage of this service so far.



? The Town Manager reminded the Selectboard that the public hearing for the Main Street traffic plan will be presented by the State of New Hampshire Department of Transportation on February 28th, at 6pm.



Public participation

? Wilfred Bishop asked what was happening regarding energy conservation and if the Town be auditing energy use. He also mentioned that the water use registration program and conservation program are important issues. Finally, he noted that North Country Council's website was hacked into that day, and would be out of communication for about a month.



? Charlie Cook reported on various Trustee of Trust Funds issues, such as his research on the establishment of the Cemetery Trust Funds and the Memorial Monument Fund.



The meeting was adjourned at 6:12 pm and Mr. Sutton left. The Selectmen then reviewed payroll and accounts payable check registers for the week ending February 11, 2007.
