Meeting Minutes
July 30, 2007

Present: Chair Deanna Huot, Selectman Peter Moore, Selectman Patricia McTeague, Town Manager Ted Sutton, Recording Secretary Susan Chenard
Audience members: Charlie Cook, Rick Kelley
At 5:00 pm, Chairman Huot made a motion to reconvene the meeting once the Board and audience member returned from the site visit of the Riverside Terrace units at South Peak; seconded by Selectman Moore. Vote was unanimous. Selectmen Huot, Moore and Mcteague, Recording Secretary Chenard and Audience Member Charlie Cook left to meet Stan Duda at the condominiums and were duly impressed. They returned and reconvened at 6pm.
Approval of public meeting minutes of July 23, 2007: A motion was made by Selectman McTeague, seconded by Selectman Moore, to approve the public meeting minutes of July 23, 2007, as written. The vote was unanimous.
Routine Business
? Public Comments re: the conveyance of Map 16, Lot 312 (White Water Treatment Plant) to the North Country Center of the Arts (NCCA). (In accordance with NH RSA 41:14-a, the Board of Selectmen of Lincoln held two public meetings on July 9, 2007 and July 23, 2007 to discuss this matter.) Selectman Moore made a motion to convey ownership of town-owned land (Map 16, Lot 312) also known as the "White Water Treatment Plant" property, in accordance with the powers vested in the board of Selectmen by NH RSA 41:14-a to the North Country Center for the Arts, contingent on three conditions: One) That the property be accepted on an "as-is" basis, absolving the Town of Lincoln of any further responsibility from any environmental hazards that may be present. Two) That there will be a deeded right-of-way providing access to the adjoining town-owned parcel of land. Three) That the Town will be granted a right of first refusal to purchase the land from the North Country Center for the Arts should the organization ever decide to give it up. Selectman Mcteague seconded the motion and the vote was unanimous. Rick Kelley, NCCA Board Chairman, was in the audience and thanked the board for their vote. He noted that he had already signed the papers for the environmental assessment work to be done. The North Country Center for the Arts attorney will be in touch next week to work out the details of the conveyance. Mr. Kelley also mentioned that the Papermill Theatre would remain in its present location next summer also, as Mr. Ducharme had scheduled a phased teardown of the balance of the paper mill. Chairman Huot commented on the momentous occasion and the many changes occurring in town, and hoped that history would continue to be preserved.
? Grafton County Municipal Association Update - A meeting has been scheduled for August 29th at 4pm at the Lincoln Town Hall.
? Village Core Planning Group - Last week's meeting was well-attended, with some 20 local businessmen and landowners taking part, including Town Manager Sutton and Selectmen Huot and Moore. A working group of seven was established, to be called the Village Core Planning Group, comprised mainly of developers and town representatives whose land will be physically impacted. This group will start meeting at 5pm on July 31st, and report back to the larger "interested parties" group as progress towards planning is made. The Town of Lincoln is hoping to be able to contribute up to $10,000, originally set aside for the White Water Treatment Plant removal, but will need Town Meeting approval in March to do so.
? CIP Update - The meetings of the CIP group have been set for four Thursday mornings in August, starting on the 9th at 9am.
? Liberty Road Update - This repaving has been completed and will stop the snowplows from digging up the road any further.
? Pleasant Street Update - Town Manger Sutton hasn't received the final numbers yet, but the project looks good. Town Librarian Carol Riley, who lives on Pleasant Street, asked about having a block party to celebrate the achievement after about 20 years of planning. She asked that the contractors be invited as well.
? Paul Hodes Funding for Levee Update - Representative Hodes was unsuccessful in getting funding for the Lincoln Levee Reconnaissance Study this season, but asked us to resubmit the request in January.
? North Country Council Annual Meeting - This has been set for October 17th at the Common Man Inn in Plymouth. Also, they have sent the Memorandum of Understanding for the cost of writing two grants to fund part-time personnel, equipment and other related needs of the Fire Department. Centex will be paying for this cost.
? Workers Compensation and Liability Insurance review - David Witham from Primex, our insurance group, stopped in to review the Town of Lincoln's recent record in regards to insurance claims. We received very good marks on the MOD factor. There will be a cost savings to the Town because of this low rating.
Other Business
? New NPDS permit - The new NPDS permit has been received from the EPA. There are some changes, though the parameters for copper have gone down somewhat, and more sampling will need to be done. Town Manager Sutton will meet with Aquarion and FCI shortly. We have the final results on the copper study we did for the whole town and the results show that FCI contributes 62%. Town Manager Sutton toured the FCI facility recently and said it looks well taken care of, but noted that FCI is resisting funding remediation needed to meet the new EPA standard.
? Rapids Development - The Town Manager is still working with the developers of the Rapids and the Planning Board regarding site plan review and concerns about materials buried on the site. He has been speaking with DES, solid waste and hazardous division. Some Planning Board members are nervous due to the serious toxicity of some items and are holding off making their decision until DES has made their final assessment. Kalene Kensington, from DES Solid Waste Division, spoke with the Town Manager this morning and said there were some red flags that have not yet been analyzed by their division.
? Bears in town¬ - The Health Officer has had to send out several letters to properties along Pleasant Street and now Pollard Road due to a large bear raiding the Dumpsters. We do have a wild animal ordinance which requires bear-proof trash receptacles.
? PILOT session - Selectman Mcteague attended the Right to Know session at Primex last Tuesday, which was also well attended. She felt we were in compliance, but should make a policy regarding opening of sealed minutes. She also mentioned that sequential emails and telephone polling are not allowed. Also, minutes are now due in 5 business days rather than 72 hours. Finally, she mentioned that a meeting could be "paused" while the Board members left to review documents from a lawyer, then reconvened, without necessarily going into non-public session.
? Solid Waste Audit - Selectman Moore asked about the solid waste audit. Both Woodstock and Lincoln Boards of Selectmen will meet with North Country Council for a scoping meeting before the study starts around October 1st. The Town Manager received some comments from Skip Graham.
? Ballfield Dedication - The dedication of the new ball field has been rescheduled to the 15th of September.
? Timber Cut - Chairman Huot also asked about the Fay Wayside Timber Cit, which was approved by the Town Manager last week. Rumford Paper will be doing the cutting and we should receive about $3500 in timber taxes when they are done.
? Senior Meals - Chairman Huot noticed a newspaper ad regarding senior meals and activities at the Masonic Temple, and asked if this was an error or separate from our Community Center activities. Town manager Sutton will check with Tara Tower.
? Child Care Center - Selectman McTeague asked about the Child Care Center. Town Manager Sutton and Tara Tower had met with them regarding the addition to the Father Roger Bilodeau Community Center and worked out a plan to help reduce the effects of the construction on their operation. Selectman Mcteague also asked about the rent payment due from the Child Care Center, to which the Town Manager replied that he and the Community Building Committee would be meeting with them on Wednesday, August 8th, to work out a payment plan for back and future rent.
? Disclaimer - Chairman Huot asked about shrinking or removing the disclaimer now at the bottom of our stationary regarding discrimination. Town Manager Sutton replied that it is needed due to Federal funding we receive.
Audience Participation
? Charlie Cook mentioned several dangerous intersections, such as the corner of Pollard Road and Dodge Place, where a birch tree is really limiting visibility. A similar corner is at corner of Maple Street and Pollard Road, where a bush and a 120 degree turn create poor visibility. Mr. Cook also mentioned the sandwich board which is on the small island at InnSeason, making it very difficult for people in low cars to see around. There was also discussion of the intersection across from the Citizens Bank, which needs more marking. Even though some vehicles stop to let people across, others try to pass the stopped vehicles on the right and almost hit pedestrians.
At 7:10 pm, Town Manager Sutton left and the meeting was adjourned. The Selectboard then reviewed payroll and accounts payable check registers for the week ending July 29, 2007.
