NOTICE OF PUBLIC HEARING

On Wed, 01-29-2020, commencing at 6:00 PM the Planning Board will hold a Public Hearing on Application for Waiver of Site Plan Review Regulations, Article IV, Change or Expansion of Use subparagraph (d) which requires Site Plan Review approval to change from one category of permitted or special exception use (customer service – dental office) to another such category of listed use (restaurant use), regardless of whether the change involves construction.  Applicant Hermann Pfeuti d/b/a HGP Holdings, LLC, PO Box 114, Lincoln, NH 03251-0114, owns 2 adjacent business condo units in Building 1, Unit #4 and Unit #5 at The Depot, 264 Main Street where he operates a restaurant known as Black Mountain Burger, Co.  He purchased the dental office next door in Building 1, Unit #6 (Tax Map 117, Lot 120-000-01-00006).  The property is located in the General Use (GU) District.

Pfeuti wants to change use of Unit #6 from dental office into an extension of his restaurant use next door.  Approximately one third (1/3) of the front space will be used for public space for the restaurant whereas the rear two thirds (2/3) of the space will be used for the restaurant office and storage.  He would use the space as follows:

larger indoor waiting area for customers in the front of restaurant;

additional 2 tables with 5 seats each = 10 more indoor seats;

office space for restaurant;

existing bathroom for the restaurant waiting area & office; and additional storage space for large cooler & other supplies for the restaurant.

Pfueti requested a Waiver of Site Plan Review approval.  The current Permit of Assembly for Black Mountain Burger Co (Unit 4 and Unit 5) is for ninety (90) indoor seats and twenty (20) outdoor seats.  The 10 additional restaurant indoor seats will not require any more parking than the dental office did.

Upon a finding by the Board that the applications meet the submission requirements of the Land Use Plan Ordinance and Site Plan Review Regulations, the Board will vote to accept the application as complete, and, if the Planning Board finds the application to be complete, then a public hearing on the merits of the proposal will follow immediately.

Should a decision not be reached at the public hearing, this application will stay on the Planning Board agenda until such time as it is either approved or disapproved.
